These Terms of Service (“Terms”) govern your use of the Tumoda mobile application, website, and related services (the “Services”), provided by Tumoda, Inc. (“Tumoda,” “we,” “us,” or “our”). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be at least 13 years old and legally able to agree to these Terms. You must provide an email address you are authorized to use and protect access to that inbox and your devices. You are responsible for activity under your account. Contact support@tumoda.com if you believe your account is compromised.
2. The Services
Tumoda helps you build a private digital closet from outfit photos, keep outfit and wear history, plan future outfits, receive wardrobe recommendations, create AI-generated garment representations, and interact with a closet-aware stylist. Features may change as the Services improve.
Tumoda does not guarantee that garment detection, duplicate matching, catalog imagery, recommendations, weather information, or AI responses will be complete, exact, or suitable for every situation. Generated images are representations for closet presentation and styling, not authenticated product images. You remain responsible for reviewing suggestions and deciding what to wear, buy, save, or share.
3. Your content
You retain ownership of photos, text, and other content you submit (“Your Content”). You grant Tumoda a limited, non-exclusive, worldwide license to host, copy, process, transform, and display Your Content only as necessary to operate, secure, improve, and support the Services as described in the Privacy Policy. This license ends when Your Content is deleted, except for limited backup, legal, and security retention.
You represent that you have the rights and permissions needed to submit Your Content. Do not upload content that is illegal, harmful, exploitative, infringing, or that violates another person’s privacy or publicity rights.
4. AI features
AI output can be inaccurate, incomplete, or unexpected. You must not rely on Tumoda for professional, medical, safety, financial, or legal decisions. You may not use the Services to identify a person, infer sensitive traits, create deceptive impersonations, or generate illegal or abusive content.
5. Tumoda Pro and Apple subscriptions
Tumoda offers optional auto-renewing monthly and annual subscriptions through Apple. The App Store purchase screen shows the price, billing period, available introductory offer, and eligibility before purchase. Payment is charged to your Apple Account. Unless canceled, a subscription renews automatically at the price shown by Apple for the next period. Manage or cancel it in your Apple Account settings. Apple controls billing, refunds, taxes, and introductory-offer eligibility under its terms.
Restoring a purchase may require the same Apple Account used to subscribe and a Tumoda account to which the entitlement can be associated. Contact support if an existing subscription does not restore.
Deleting your Tumoda account does not cancel a subscription billed by Apple. Cancel the subscription separately through Apple to prevent future renewal.
Tumoda may change which features are free or included in Pro on a prospective basis. We will not intentionally remove access to wardrobe data you created solely because a subscription expires, although AI-powered or premium actions may become unavailable.
6. Acceptable use
You may not:
- break the law or violate another person’s rights;
- probe, disrupt, overload, reverse engineer, or bypass security or usage limits of the Services, except where law expressly permits;
- use automated means to scrape or access the Services without permission;
- upload malware or harmful code;
- misuse AI features to identify people or infer sensitive traits;
- resell or commercially exploit the Services without written permission; or
- use Tumoda to develop or train a competing model or service using outputs or private service behavior, except where law requires otherwise.
7. Tumoda intellectual property
Tumoda and its licensors own the Services, software, design, branding, and other materials other than Your Content. Subject to these Terms, Tumoda gives you a limited, personal, revocable, non-transferable license to use the app for its intended consumer purpose.
8. Availability and changes
We may change, suspend, or discontinue features and may impose reasonable usage limits to protect reliability, safety, and cost. We aim to preserve access to user-owned closet data and will provide notice when required. The Services may occasionally be unavailable due to maintenance, networks, vendors, or events outside our control.
9. Termination and deletion
You may stop using Tumoda at any time and may request account deletion in Settings. We may suspend or terminate access for a material violation of these Terms, security risk, fraud, unlawful conduct, or extended nonpayment of paid services. Where appropriate, we will provide notice and an opportunity to appeal.
Sections that by their nature should survive termination—including ownership, disclaimers, limitations, dispute terms, and lawful retention—will survive.
10. Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available.” Tumoda disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes rights that cannot legally be excluded.
11. Limitation of liability
To the extent permitted by law, Tumoda and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, revenue, profits, goodwill, or opportunities arising from the Services. Tumoda’s aggregate liability for claims relating to the Services will not exceed the greater of the amount you paid Tumoda through Apple during the 12 months before the claim or USD $100.
12. Governing law and disputes
These Terms are governed by the laws of the State of Colorado, excluding conflict-of-law rules, unless your local consumer law requires otherwise. State and federal courts in Colorado will have jurisdiction, except where applicable law permits you to bring a claim elsewhere.
13. Changes to these Terms
We may update these Terms. We will post the new effective date and provide additional notice for material changes when required. Continued use after the effective date constitutes acceptance to the extent permitted by law.
